We can attribute this one instance to what is known as Police Accountability. For many individuals, the example given above does not represent a compelling enough cause for someone to care about police accountability.

Police misconduct disclosure is just one of the methods an officer may go unnoticed without being held accountable for prior erratic behavior. The Cato Institute Police Misconduct Reporting Project was a resource that assisted me in answering the question why police misconduct information is permitted to be revealed across many police forces.
According to a study done in 2016 by the Cato Institute, there were about 1,800 police misconduct cases that were reported. Of those reported cases, 78% were for excessive force, 9% were for sexual assault, 8% were for false arrest, and the remaining 5% was a combination of various other types of misconduct. The study goes on to say that these are only the cases that were actually reported and that the total number is likely much higher.
So why is it that this information is not made public? Wouldn’t it be in the best interest of both the police department and the public to know if an officer has a history of misconduct?
The answer lies in something called “police unions.” Police unions are organizations that exist to protect the interests of police officers. One of their main goals is to make sure that officers are not held accountable for their actions. They do this by fighting for things like due process and qualified immunity.
Qualified immunity is a legal doctrine that makes it very difficult to sue a police officer for misconduct. It essentially says that an officer can only be held liable if they violated a “clearly established” law. This is a ridiculously high standard to meet, and it often results in officers getting away with things that would get ordinary citizens in trouble.
