On 6/14/2015 at approximately 1833 hours, I was conducting a security walk in Tower 12-B Pod at the Lower Buckeye Jail (address listed above). After I completed the walk in B podl came up to cell 8 and noticed (V1) Inmate Stark, Arthur MCSO Booking Number (T174712) was laying on the lower bed inside his assigned cell with a pink Inmate towel over his forehead. I then asked Inmate Stark why he didn’t come up to get his evening meal. Inmate Stark then stated to me, “I am not hungry”. I then ordered Inmate Stark to remove the pink Inmate towel from his head.
Once the pink Inmate towel had been removed from Inmate Stark’s head, I noticed that he had a few cuts on his forehead and bruising all around his head. I then asked Inmate Stark how he had sustained all the injuries. Inmate Stark then stated to me, “I slipped and fell in the shower. ” I then made a radio call to the Tower 12 Tower Officer to close cell 8 so that Inmate Stark would be secured inside of his assigned cell. I then exited Tower12- B Pod to get Officer Remillard (B2942) to come help me escort Inmate Stark to a Level 1 Holding Tank.
At approximately 1845 Inmate Stark was escorted and placed into a Level 1 holding tank by myself and Officer Remillard. I asked Inmate Stark how he received all of the injuries on his face and head. Inmate Stark responded by saying “An inmate in the pod had taken my canteen. I went into cell 16 to get it back. ” I asked Inmate Stark if he could identify any of the inmates that assaulted him. He replied, “Cell 10 bottom bunk. His name is Peter. ” I then asked Inmate Stark if he knew how many people were involved in his assault and he stated, “No.
I don’t because I blacked out”. Inmate Stark was not willing to aid in prosecution. I did not ask Inmate Stark any further questions at this time. At approximately 1845 hours I viewed the surveillance video for Tower 12 B pod on camera C1257. At approximately 1806 Inmate Hendy going into cell 16 and throwing off his shirt onto the bottom bunk. Then you see Inmate Lopez walk towards cell 16 and stand outside of the cell. Then following that, Inmate Byassee goes and stands next to Inmate Lopez. Then the video shows Inmate Stark walking into cell 16.
After several seconds Inmate Lopez and Inmate Byassee go into cell 16. After both inmates enter the cell there is more movement in the back of the cell. At approximately 1808 you see Inmate Hendy come out of cell 16 with his shirt on followed by Inmate Lopez and Inmate Byassee. You see another Inmate high-five and hug Inmate Hendy. On video you then see Inmate Stark walk out of cell 16 last and Inmate Stark makes his ways to the showers, and as this is happening Inmate Hendy is then shown on camera wiping up the floor in cell 16 with a pink inmate towel.
At approximately 2030 I interviewed (S1) Hendy, Peter Frank MCSO Booking Number T140002. I read Inmate Hendy his Miranda Rights from my MCSO Standard Issue Miranda Rights card. I asked Inmate Hendy if he understood his rights and he stated, “Yes”. I then asked Inmate Hendy if he was willing to voluntarily answer my questions and he stated, “Yes Ma’am”. I asked Inmate Hendy what he was doing right before the Tower Officer announced to lock down for their evening meal. Inmate Hendy replied, “I was in my cell, since they played the recording to lock down”.
I then asked Inmate Hendy what he was doing evening meal. Inmate Hendy replied by saying, “I was walking laps around the pod. ” I then asked Inmate Hendy if he knew anything about what happened to Inmate Stark right before serving their evening meal. Inmate Hendy replied by saying, “I have no idea, I don’t even know why I am out here. ” I asked Inmate Hendy if he was involved in an assault today, and he replied “No. ” I informed Inmate Hendy that he was named as a suspect in an assault and he replied, “Whoever said that is lying. I don’t know anything. At this time I no longer questioned Inmate Hendy. I began my next interview with (S2) Lopez, Arturo Jorge MCSO Booking Number T184169. Then read Inmate Lopez his Miranda Rights from my MCSO Standard Issue Miranda Rights card. I asked Inmate Lopez if he understood his rights and he stated, “Yes”.
I then asked Inmate Lopez if he was willing to voluntarily answer my questions and he stated, “Yes”. Tasked Inmate Lopez what he was doing right before the Tower Officer announced to lock down for their evening meal. Inmate Lopez said, “I was on the phone with my sister. I then asked Inmate Lopez if he knew anything about Inmate Stark being assaulted. Inmate Lopez then said, “No I don’t, I was on the phone with my sister who had all my attention since she is paying for the call and I don’t really care what else was happening at the time. ” I informed Inmate Lopez that he can be seen on the video recording entering cell 16 as an assault was taking place. He replied, “Nope, I was on the phone with my sister. ” At this time I did not ask Inmate Lopez any further questions at this time. I began to interview (53) Inmate Byassee, Kyle MCSO Booking Number T179547.
I started off by reading Inmate Byassee his Miranda Rights from my MCSO Standard Issue Miranda Rights card. I asked Inmate Byassee if he understood his rights and he stated, “Yes”. I then asked Inmate Byassee if he was willing to voluntarily answer my questions and he stated, “Sure, Yes”. I then asked Inmate Byassee what he was doing right before the Tower Officer announced to lock down for their evening meal. Inmate Byassee said, “Nothing, just hanging out. ” I asked Inmate Byassee if he knew anything that happened with Inmate Stark.
Inmate Byassee then stated “No I am just trying to stay out of trouble while I am here, you know? ” I asked Inmate Byassee if he had any information about an assault that happened in cell 16. He replied “I keep to myself. I stay out of whatever goes on in the pod. ” I informed Inmate Bayssee that he was identified as being involved in an assault. Inmate Bayssee refused to respond to my statement. Tasked no further questions at this time and escorted Inmate Byassee back. At approximately 2035 hours Inmate Stark was seen by RN Stacey RG710 for any injuries he may have received.
After being evaluated by RN Stacey he was ordered to be transported to Maricopa Intigrated Health System (MIHS) by Pat Lilly CS120 for head trauma. Inmate Stark was immediately taken out on a gurney to the LBJ Main to await transport to MIHS At approximately 2040 hours I was unable to take pictures of Inmate Stark due to him being transported to MIHS. Officers Kramperth B3038 and Canzona B1449 escorted the Inmate Stark to MIHS via Southwest Ambulance #PMT417. Video of the incident will be impounded by FTO Edwards B1638.
